Terms and conditions of sale

These terms and conditions govern sales concluded through the Minty store between MINTY LABS SAS and any consumer acting for purposes outside their trade or profession.

1. Seller’s identity

MINTY LABS SAS, a French simplified joint-stock company with share capital of €100, registered with the Bourg-en-Bresse Trade and Companies Register under SIREN number 994 164 630, SIRET 994 164 630 00018, EU VAT number FR79 994 164 630, registered office: 329 Rue des Carpières, 01170 Ségny, France. Contact: contact@minty-card.com.

2. Products

Minty sells trading card products, including sealed Japanese Pokémon products. Each product page states the essential characteristics, language, condition, advertised contents and, where relevant, whether the original plastic wrap (“shrink”) is present. Photographs are presented with the utmost care but cannot provide an absolute guarantee of colour reproduction or printing details.

Minty is an independent store and is neither affiliated with, sponsored by nor endorsed by The Pokémon Company, Nintendo, Creatures Inc. or GAME FREAK, unless expressly stated otherwise.

3. Prices

Displayed prices are in euros and include all taxes, unless otherwise stated. Any delivery charges are shown before the order is finally confirmed. Minty may change its prices at any time; the applicable price is the one displayed when the order is placed.

4. Orders

The customer selects the products, checks the order summary, supplies the requested information and confirms payment. The order is final only after confirmation by the store and validation of payment. Minty reserves the right to refuse or cancel an order in the event of suspected fraud, an obvious pricing error, actual product unavailability or a previous payment dispute, in accordance with the law.

5. Payment

The available payment methods are those offered at checkout. Payment is processed by the payment providers enabled on Shopify. Minty does not retain full payment card details.

6. Availability

Products are offered while stocks last. If a product becomes unavailable after an order is placed, the customer is informed as soon as possible and refunded if the order cannot be fulfilled.

7. Delivery

Orders are prepared in France. Delivery methods, their costs and the applicable delivery time or date are presented before the order is confirmed. If no date or deadline has been agreed, the statutory rules governing delivery apply.

The customer must provide an accurate and complete address. An address error attributable to the customer may result in reshipping charges. The risk of loss or damage passes to the consumer when they take physical possession of the goods, subject to the statutory exceptions where the consumer chooses a carrier not offered by Minty.

8. Right of withdrawal

For distance purchases of goods, the consumer generally has a period of 14 days from receipt of the goods to notify their decision to withdraw without giving a reason. The request may be sent to contact@minty-card.com by means of an unequivocal statement or the model form below.

After notification, the consumer has 14 days to return the product. Unless Minty made an error or the product is non-conforming, the consumer bears the direct cost of return. The product must be properly protected for transport. The consumer may be held liable for diminished value resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the goods.

The refund covers the amounts paid, including standard delivery costs where required by law. It is made within the statutory time limit; Minty may withhold the refund until the goods are received back or proof of return is provided, whichever occurs first.

The mere fact that a trading card product was delivered in plastic wrap does not, in itself, remove the statutory right of withdrawal. Any diminished value is assessed in light of the actual condition of the returned goods and the handling carried out.

“I hereby give notice that I withdraw from my contract of sale for the following goods: [product]. Ordered on: [date]. Received on: [date]. Consumer’s name: [name]. Consumer’s address: [address]. Date: [date]. Signature (only for a paper form): [signature].”

9. Statutory guarantees

The consumer benefits from the statutory guarantee of conformity under the French Consumer Code and the guarantee against hidden defects under the French Civil Code. For the goods concerned, the statutory guarantee of conformity may be invoked for two years from delivery. Goods are brought into conformity free of charge under the conditions laid down by law. These guarantees apply independently of any commercial warranty.

To report a damaged, incorrect or non-conforming product, the customer may email contact@minty-card.com with the order number and, where helpful for processing, photographs of the parcel and product.

10. Liability

Minty remains responsible for properly fulfilling its legal obligations. No provision of these terms is intended to exclude or limit the consumer’s mandatory rights.

11. Intellectual property

The Minty store’s original content, including text, visual identity, graphics and editorial organisation, is protected by applicable rights. Third-party trademarks and images remain the property of their respective owners.

12. Personal data

The processing of personal data is described in the Privacy Policy available in the store.

13. Complaints and consumer mediation

All complaints must first be sent to contact@minty-card.com.

As of 11 September 2026, MINTY LABS SAS has not yet provided details of a consumer mediator. Sales to consumers must remain disabled until the company joins a listed consumer mediation service and adds its name, contact details and website to these terms and to the store.

14. Applicable law

These terms are governed by French law. For a consumer residing in another country, any mandatory protective provisions applicable to them remain unaffected. In the event of a dispute, the statutory rules on jurisdiction applicable to consumers apply.
